In 1996 Binz commented on behalf of the Competition Policy Institute to the FCC on the use of LMDS spectrum.  CPI supported the FCC's policy of keeping incumbent telecommunications and cable companies from obtaining licenses for use of LMDS spectrum. CPI agreed with the FCC that such limits would help ensure that new telecommunications entrants would use the spectrum to compete with incumbents.

In 2000, the FCC considered whether to allow the LMDS license ownership restrictions to sunset or to extend the restrictions. Based on its analysis of the use to which the spectrum had been put, CPI supported removal of the restrictions.
